Terms of Service
1. Provider
The Melkur Fleet service (the "Service") is provided by MELKUR PARTNER Sp. z o.o., ul. Grzybowska 87, 00-844 Warszawa, Poland, NIP 5273102512, KRS 0001092411, share capital PLN 10,000 (the "Provider", "we").
2. Scope
The Service is a web application for managing vehicle fleets — vehicles, insurance, inspections, drivers, contractors, bookings and related records. These Terms govern its use.
3. Rights to the Service
The Service, including its software, interface, design, name and logo, is the property of the Provider and is protected by law. Under these Terms you receive a limited, non-exclusive and non-transferable right to use the Service for the duration of your subscription. No rights other than those expressly granted here are transferred to you.
4. Account
To use the Service you create an account. You are responsible for the accuracy of your data, for keeping your login credentials secure, and for all activity under your account.
5. Free trial and fees
New accounts start with a 30-day free trial, no payment required. After the trial the account moves to the free plan with 1 vehicle; your data is kept. A paid plan is required only for a larger fleet and for optional modules. Prices are shown on our website and are net of VAT. Fees are billed to your company. Optional modules are billed separately from the day they are enabled. The charge for the current period is taken immediately, the module stays active until the end of the paid period and the fee is not refunded.
6. Acceptable use
You agree not to use the Service unlawfully, not to disrupt its operation, not to attempt unauthorised access, and not to upload content that infringes third-party rights. You further agree not to copy, decompile or reverse engineer the Service, not to reproduce its interface or structure, not to collect data from it by automated means, not to resell or share access with third parties, and not to use the Service to build a competing product.
7. Your data
Data you enter remains yours. We process it to provide the Service, as described in our Privacy Policy. For personal data you enter about third parties, we act as processor on your behalf.
8. Availability
We aim for high availability but do not guarantee uninterrupted access. Maintenance, updates or factors beyond our control may cause temporary interruptions.
9. Liability
To the extent permitted by law, we are not liable for indirect damage or lost profits. The Service is provided "as is". Nothing limits liability that cannot be excluded by law.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms. After termination your data may be deleted following a reasonable period.
11. Changes
We may update these Terms. Material changes will be announced in the Service or by email. Continued use after changes means acceptance.
12. Governing law
These Terms are governed by Polish law. Disputes with business customers fall under the court competent for the Provider's registered seat. Mandatory consumer rights are unaffected.
